6. Governing Law and Dispute Resolution
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims), shall be governed by, and construed in accordance with, the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.
7. Changes to the Terms
Reservaline Limited reserves the right to modify these Terms at any time. Changes will be posted directly on this page with an updated effective date. Continued use of DISCOVERY EDITION following any amendments constitutes your formal acceptance of the revised Terms.
8. Dispute Resolution & International Commercial Clause
- Negotiation in Good Faith: In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the Service, or any commercial partnership associated with DISCOVERY EDITION, the parties shall first attempt to resolve the matter amicably through direct business negotiation.
- Mediation: If the dispute is not settled through negotiation within thirty (30) days of written notice of the dispute by either party, the parties agree to attempt to settle it by mediation in accordance with the Centre for Effective Dispute Resolution (CEDR) Model Mediation Procedure, taking place in London, England.
- Jurisdiction Exception for International Partners: While the courts of England and Wales retain exclusive jurisdiction for general enforcement and legal actions under English law, Reservaline Limited reserves the right—at its sole discretion—to initiate collection, copyright-infringement, or commercial breach proceedings against international partners in the competent courts of the defendant’s local jurisdiction or principal place of business.
